[U.S. House Ways and Means Committee Passes Crypto Tax Bill Review 38–5, Reports to Full House] Foresight News reports that the U.S. House Ways and Means Committee today completed its review of the 'Digital Asset Tax Certainty Act' (H.R. 10357), passing the amended text with 38 votes in favor and 5 against, and reporting it to the full House. During the review, two amendments proposed by Democratic Representative Lloyd Doggett were rejected: the amendment on 1099 reporting obligations for non-custodial and DeFi platforms was voted down 12–28, and the amendment requiring a study on the impact of crypto mining on electricity and the environment was rejected 16–25. The bill, introduced by Ways and Means Committee Chairman Jason Smith on September 14, includes the following key provisions: on-chain network fees under $10 per transaction may be excluded from taxable events if certain conditions are met (excluding those with over 5,000 transfers in the previous year); extending wash sale and constructive sale rules to digital assets, with exemptions for qualified dollar stablecoins; clarifying the nature and source of income from mining and staking (without including the 'tax upon receipt, defer until sale' provision); as well as provisions on broker reporting, lending transfers, and stablecoin simplification. The bill must still pass the full House, the Senate, and be signed by the President to become law. The House will recess later this week until after the midterm elections, and the full House schedule has yet to be determined.
