This is too magical! Back then, Musk foolishly emphasized that OpenAI was a 501 (c) 3 institution, but now
In an interview just six months after OpenAI was founded, Ultraman asked Musk for his opinion on the "Company", and Musk corrected his statement on the spot, emphasizing that OpenAI's structure is a 501 (c) (3) non-profit organization.
Back in 2015, OpenAI was established as a 501 (c) (3) tax exempt non-profit research laboratory. Public court records show that Musk provided over $44 million in initial funding at this stage.
In 2019, OpenAI was restructured as a "profit cap" entity and received initial investment from Microsoft. By October 2025, without a new round of financing, internal employee stock secondary market transactions will push OpenAI's valuation up to $500 billion. Currently, OpenAI has nearly 1 billion weekly active users and is preparing for an initial public offering at a valuation of nearly $1 trillion.
Elon Musk's $134 billion damages lawsuit against OpenAI and its CEO Sam Ultraman has entered the jury trial stage in Oakland Federal Court, California.
The core allegations of this lawsuit are violations of charitable trusts and unjust enrichment. Musk stated in court documents that Ultraman transformed the non-profit organization he assisted in founding into a for-profit entity supported by Microsoft, requesting to block OpenAI's restructuring and return the related funds to a charitable trust.
