[Texas Court Dismisses Developer Pharos' Request for Software Exemption from Money Transmission Laws] Deep Tide TechFlow reports that on March 26, according to Cointelegraph, Chief Judge Reed O'Connor of the Texas Federal District Court dismissed a lawsuit filed by crypto developer Michael Lewellen this Wednesday. The lawsuit sought a declaratory judgment from the court to confirm that his donation crowdfunding software, Pharos, is not subject to money transmission laws. The court ruled that Lewellen failed to demonstrate a real and imminent threat of prosecution and cited a memorandum from the Department of Justice—which indicated that the DOJ no longer pursues legal action against end-user activities involving virtual currency exchanges, mixing services, or offline wallets. The case was dismissed "without prejudice," allowing Lewellen to refile the lawsuit after amendments. Lewellen stated that his legal team is exploring follow-up strategies.
