Is it illegal to use VPN to bypass walls in China?
To be frank, currently there is no clear legal basis for using VPN to bypass walls, but local governments often consider it illegal during operation. Of course, this is not important because China has recently issued the latest "Cybercrime Prevention and Control Law", which is currently in the draft stage for soliciting opinions. The deadline is early March 2026.
If this "Cybercrime Prevention and Control Law" is officially implemented, it will be a law. This law covers a lot of content, and interested parties can take a closer look. There are many articles related to VPN VPN VPN, including:
1. Changing the installation address of network or telephone lines without registration.
2. Equipment and software with functions such as changing the calling number, virtual dialing, and illegal Internet phone access to the public telecommunications network.
3. Other equipment, software, tools, and services identified by public security organs at or above the provincial level in conjunction with competent departments such as telecommunications, broadcasting, and television, specifically used to commit cybercrime or have the function of evading regulatory systems.
4. It has network virtual positioning function.
5. Those who provide server hosting, space rental, and cloud services should take measures such as monitoring, discovering, blocking, and disposing of illegal information, websites, applications, denial of service attacks, malicious code, botnets, and illegally established virtual private networks.
6. The national cyberspace administration shall coordinate relevant departments and network operators to take technical and other necessary measures to block illegal information originating from outside the People's Republic of China. Network operators shall promptly take measures to block network domain names, network addresses, network accounts, telephone lines, network lines, and applications used for illegal and criminal activities, and report to the competent authorities such as the public security organs. No individual or organization shall violate relevant national regulations by producing, selling, or providing relevant equipment, software, tools, lines, or services, or providing technical support or assistance for others to obtain or disseminate information that has been lawfully blocked.
In addition, there are also those related to cryptocurrency, such as:
Using virtual currency or other virtual assets on the internet to provide fund transfer services for others.
So what will be the punishment for using VPN to bypass walls and other illegal activities?
1. (Involving VPN use) Those who violate the provisions of Articles 11 to 13 of this Law, disrupt the real name registration system, etc., shall have their illegal gains confiscated by the public security organs and be fined not less than one time but not more than ten times the illegal gains. If there are no illegal gains or the illegal gains are less than 20000 yuan, a fine of not more than 200000 yuan shall be imposed; Those with serious circumstances shall be detained for no more than fifteen days. The relevant competent authorities may blacklist the individuals and organizations who have been subject to administrative penalties mentioned above, and order the relevant service providers to take disciplinary measures such as restricting their use, limiting or prohibiting the opening of card numbers.
2. (Involving VPN use and virtual currency) Those who violate the provisions of Article 14, Article 15, Article 17 (3), and Article 44 (3) of this Law by producing, selling, providing, or using relevant equipment, software, tools, and services shall be confiscated by the public security organs, internet information departments, telecommunications regulatory departments, market supervision departments, etc. in accordance with their responsibilities, and fined between one and ten times the illegal gains. If there are no illegal gains or the illegal gains are less than 50000 yuan, a fine of up to 500000 yuan shall be imposed; If the circumstances are serious, the public security organs shall also detain for no more than fifteen days.
3. If a VPN service provider violates the provisions of Articles 19 to 33 of this Law and disrupts network order, the public security organs, cyberspace administration departments, telecommunications regulatory departments, financial, market supervision, cultural and tourism regulatory departments shall, in accordance with their duties, order the suspension of relevant business, suspension of business rectification, closure of websites or applications, revocation of business licenses or permits, and impose a fine of not less than one time and not more than ten times the illegal gains; If there are no illegal gains or the illegal gains are less than 50000 yuan, a fine of up to 500000 yuan shall be imposed; If the circumstances are serious, the public security organs shall also detain for no more than fifteen days.
That's about it. If there's anything unclear, you can ask AI, I've read each one. Of course, this does not necessarily mean that using VPN to bypass a VPN will be considered illegal, but as a law, it is like a sword of Damocles hanging over one's head.
