He stated that the taxonomy will be anchored in the long-referenced Howey investment contract securities analysis. Atkins noted that cryptocurrencies can be part of an investment contract, but as networks mature, the role of issuers may diminish or disappear, meaning 'tokens will not always retain their status as securities.' The taxonomy is intended to complement the crypto legislation currently under review by Congress. Atkins also revealed that he has instructed staff to prepare recommendations to consider allowing tokens associated with investment contracts to trade on non-SEC-regulated platforms (such as CFTC-registered platforms).
