According to a consultation paper released by the Australian Securities and Investments Commission (ASIC) on October 12, ASIC plans to expand the definition of Contracts for Difference (CFDs) to include products settled via digital asset transfers that share the same economic characteristics as CFDs. These products would then fall under the existing regulatory framework, subject to leverage limits, standardized margin close-out rules, and negative balance protection for retail investors. However, certain crypto futures and options with fixed expiration dates will remain outside this framework.
ASIC also proposed extending the current CFD product intervention order for another 10 years and is seeking public feedback on the proposed changes until November 9.
ASIC data shows that approximately 68% of retail CFD clients experienced net losses in the 2023–24 fiscal year, with total net losses exceeding AUD 458 million.
