[NFL Supports State Regulation of Predictive Market Sports Contracts, Opposes CFTC Exclusive Jurisdiction] According to a report by Golden Finance, on October 8, the National Football League (NFL) submitted an amicus brief to the Supreme Court, supporting New Jersey's petition for certiorari in the Kalshi case. The NFL advocates that states should have the authority to regulate sports-related event contracts in predictive markets like Kalshi, opposing the Commodity Futures Trading Commission's (CFTC) claim of exclusive federal jurisdiction. The NFL stated that it has requested the CFTC and platforms to prohibit easily manipulated betting categories, restrict insider betting, and set a minimum age limit of 21, but these measures have yet to be implemented. Kalshi still allows users aged 18 to trade, while most states require individuals to be at least 21 years old for sports betting. The NFL further pointed out that the CFTC has only about 543 employees nationwide, with responsibilities spanning all derivatives, making its enforcement capacity inferior to state-level gambling regulatory agencies. This could pose risks to the fairness of events and consumer protection.
