The National Football League (NFL) has submitted an amicus brief to the Supreme Court, supporting states' regulatory authority over sports betting operations on prediction markets like Kalshi and Polymarket, and opposing the CFTC's claim of exclusive federal regulatory authority. The NFL pointed out that the CFTC's regulatory standards fall short compared to state gambling regulators, citing issues such as allowing users under 21 to place bets, the possibility of single-player actions manipulating betting outcomes, and insufficient regulatory staffing, which threaten the fairness of events and consumer protection. Former SEC Chair Gary Gensler, former Senator Chris Dodd, and multiple state and tribal governments also support state regulatory authority, arguing that the Dodd-Frank Act does not grant the CFTC the power to override state gambling regulations.
