[Kalshi Partially Wins in Illinois, Ending Federal Court Losing Streak Since July]
According to a report by Bitcoin.com on October 7, a federal judge in the Northern District of Illinois, Martha Pacold, partially granted a preliminary injunction request on October 2 filed by Kalshi, Coinbase, and the U.S. government. The ruling determined that the state's sports betting licensing system and related criminal provisions are likely preempted by federal law, temporarily prohibiting the state from requiring Kalshi to hold a state license (which would otherwise limit trading to in-state users aged 21 and above and restrict trackable events). The judge found that Kalshi's "championship" contracts are likely classified as swaps under the Commodity Exchange Act, requiring them to be traded on a designated contract market and not subject to state regulation. This marks Kalshi's first federal court victory since the Minnesota case in July. However, the judge did not rule on the proposed fees in Illinois, instead requesting supplemental written opinions.
