[CFTC Proposes Including Event Contracts in the Definition of Swaps, Excluding Casino-Style Gambling Products]
Odaily Planet Daily News: On September 28, the Commodity Futures Trading Commission (CFTC) submitted two proposed rules to the White House, aiming to include event contracts in the definition of "swaps" while excluding casino-style gambling products. The first rule will be open for public comment, while the second is a temporary final rule set to take effect upon publication, with comments to be solicited afterward. The text of the rules has not yet been released. The definition of swaps is central to the jurisdictional dispute between prediction markets and state-level gambling regulatory agencies. Recently, the Sixth Circuit Court of Appeals ruled that Kalshi's sports contracts do not fall under the definition of swaps; previously, the Third Circuit Court supported Kalshi, while the Ninth Circuit Court sided with Nevada.
