According to a report by Jinse Finance on September 30, citing Bitcoin.com via CNBC, SEC Chairman Paul Atkins stated on September 29 that even if the CLARITY Act fails in Congress, the SEC will 'proceed to provide clear guidance on on-chain fundraising.' The Act failed to pass the Senate's cloture vote on September 15, falling short of the 60-vote threshold with a 49-50 result. Atkins remarked that 'with or without legislation, we will act decisively under the SEC's statutory authority,' though he did not specify the form of the guidance (exemptions, registration pathways, or advisories). Commissioner Hester Peirce ('Crypto Mom') is set to step down on October 2, leaving the SEC with only the Chairman and Commissioner Mark Uyeda, with a Democratic seat vacant. For the remainder of the year, the SEC remains the sole regulatory avenue for industry participants seeking rules.
