It clarified that self-custodied cryptocurrencies, where the private keys are fully controlled directly by the holder, are not subject to this reporting requirement. Under the rules, two key conditions must be met to trigger the Modelo 721 reporting obligation: first, the private keys must be entrusted to a third-party custodian; second, the custodian must neither be a Spanish tax resident nor have a permanent establishment within Spain.
