[U.S. SEC Updates Cryptocurrency FAQ: Token Buybacks Without a Central Entity Typically Do Not Constitute Investment Contracts]
Foresight News reports that, according to crypto journalist Eleanor Terrett, the U.S. SEC has updated its cryptocurrency FAQ. The update includes clarification on token buybacks: if there is no central entity behind the buyback, the arrangement typically does not constitute an investment contract. This update follows comments made last week by Miles Jennings, General Counsel and Head of Policy at a16z Crypto. Jennings had previously stated that the earlier wording might 'allow issuers to announce buyback plans, and the announcement itself would not create an investment contract.'
