[CFTC Warns of Manipulation Risks in 'Speech Prediction Markets,' Requires Exchanges to Detail Safeguards]
According to a report by CryptoSlate on September 25, the CFTC's Division of Market Oversight issued staff guidance on September 22, stating that contracts tied to specific individuals' statements, appearances, or interactions carry a higher risk of being 'easily manipulated.' The guidance requires exchanges to detail safeguards on a per-contract basis, including whether the decision-makers are bound by independent obligations, whether they can be influenced, whether outcomes can be externally verified, and whether monitoring is adequate for the associated risks. The document reflects staff opinions, does not constitute binding rules, and does not prohibit such markets. Kalshi launched related markets the following day, claiming it had responded in accordance with prior discussions with the CFTC. Additionally, the CFTC disclosed that a White House teleprompter operator had profited $107,539 by trading such contracts using advance access to speech drafts.
