[U.S. CFTC Issues No-Action Position for Passive Software Providers]
According to an announcement on the CFTC's official website, the U.S. Commodity Futures Trading Commission's Market Participants Division (MPD) has issued a no-action position for service providers offering passive software. Under specific conditions, the MPD will not recommend enforcement action against such software providers and their personnel for failing to register as 'Introducing Brokers' or associated persons. The exemption is limited to the provision and marketing of such software when it facilitates users in connecting with registered Futures Commission Merchants, Introducing Brokers, and Designated Contract Markets for trading purposes.
