SEC Chairman Paul Atkins: He predicts and hopes that the CLARITY Act will pass the Senate in September and eventually land on Trump's desk for signing.
If it doesn’t pass by September 15, it’s no big deal, because the SEC isn’t waiting around for Congress to take its time. They’ve already pre-released the Regulation Crypto Assets, essentially drafting the rules for how to implement the CLARITY Act once it’s passed.
The latest Regulation Crypto Assets proposal offers two clear fundraising pathways for crypto projects within the U.S.:
One allows up to $5 million in fundraising over 4 years, while the other permits up to $75 million in fundraising every 12 months.
It also introduces a safe harbor, where, if certain conditions are met, the related crypto asset would no longer be considered under an investment contract.
Atkins was pretty straightforward: Over the past few years, the U.S. has driven developers, projects, and funding overseas. Now, it’s time to bring them back.
