SEC Chair: If the CLARITY Act Fails to Pass, Rules for the Crypto Market Will Be Issued Independently
On July 27, 2026, SEC Chair Paul Atkins @SECPaulSAtkins discussed the CLARITY Act and U.S. crypto market structure regulation during an interview with CNBC. He expressed optimism about Congress passing the act and noted that the SEC is actively assisting Congress by addressing related questions and providing technical support.
If Congress ultimately fails to take action, the SEC is prepared, willing, and capable of addressing the issues covered by the CLARITY Act through rulemaking, as well as improving regulation in other areas of the crypto market. However, Atkins emphasized that SEC rulemaking cannot replace Congressional legislation. The crypto market will still require statutory law to provide lasting certainty and establish clear safeguards for future regulatory direction and market development.
