**[CLARITY Act May Assist CFTC in Addressing Prediction Markets]**
Odaily Planet Daily News – The U.S. House Agriculture Committee's Subcommittee on Commodity Markets, Digital Assets, and Rural Development held a hearing on how the Commodity Futures Trading Commission (CFTC) regulates prediction markets. Carl Kennedy, a partner at Katten Muchin Rosenman, stated that the CFTC might be understaffed, making it difficult to adequately handle the regulation and enforcement of platforms like Kalshi and Polymarket.
Kennedy believes that the CLARITY Act, currently under Senate review, could grant the CFTC more authority, not only for digital assets but also to address the growth of prediction markets. He noted that to manage new asset classes such as cash markets and crypto assets, the CFTC would require additional resources.
Since being confirmed by the Senate in December, CFTC Chairman Michael Selig has consistently advocated for the agency's exclusive jurisdiction over relevant companies, asserting that event contracts on these platforms fall under the swaps category within the CFTC's regulatory scope. Some U.S. states have already filed lawsuits against Kalshi and Polymarket over disputes related to sports betting, and these cases may ultimately reach the U.S. Supreme Court.
