For almost 30 years, I’ve sued major corporations, including Monsanto, Dow Chemical, and others, for poisoning people - causing their deaths. I’ll fight for people in the U.S. senate a lot harder than someone like @EdMarkey - who’s been in office for 53 years. The Supreme Court’s decision is yet another example of why my Washington Clean Hands Act is desperately needed. It would prevent the regulatory capture we see rampant among our regulatory agencies - including the EPA. The Supreme Court ruled pesticide law (FIFRA) controls what goes on a label and a state jury can’t effectively force a different label - like adding a cancer warning - through a lawsuit verdict - even if state tort law just requires “adequate” warnings. The truth: Monsanto should have included a cancer warning on the Roundup label even if the EPA didn’t require it. That specific theory is now foreclosed by federal preemption - across the nation. If I was in the Senate I’d write a bill to stop this and allow people to pursue their valid state law claims.(John E Deaton)
