The U.S. Commodity Futures Trading Commission (CFTC) is suing Kentucky, accusing the state of attempting to shut down federally regulated prediction market platforms, thereby infringing on the CFTC's exclusive regulatory authority over such markets. Previously, Kentucky had filed lawsuits against platforms like Kalshi and Polymarket, alleging they were operating unauthorized sports betting and gambling businesses locally. In its complaint, the CFTC stated that prediction markets fall under the federally regulated framework of Designated Contract Markets (DCM), which state governments have no authority to restrict. Kentucky has now become the ninth state sued by the CFTC, following similar lawsuits against Wisconsin, Illinois, Arizona, Connecticut, New York, New Mexico, Minnesota, and Rhode Island.
