According to Web3 criminal lawyer Zhang Suhang, he is currently handling a case in Qinghai involving alleged illegal business operations. The individuals involved used the heat generated by Bitcoin mining machines to provide heating for enterprises, which was later investigated by the police under suspicion of illegal business operations.
Zhang Suhang stated that the dispute in the case revolves around whether this behavior constitutes typical virtual currency mining operations, whether relevant regulatory documents can be considered as 'violating national regulations' under the illegal business operations charge, and whether it reaches the level of 'seriously disrupting market order.' He believes the project in question meets a genuine heating demand, with approximately 100 machines in operation, primarily during the heating season, and has not generated significant profits. In the absence of sufficient evidence to meet the criteria for illegal business operations, the case should not proceed as a criminal matter.
