Outgoing CME CEO Terrence Duffy stated that CME will sue the CFTC starting Thursday, opposing its approval of perpetual futures in the U.S. market. Previously, the CFTC approved prediction market platform Kalshi to offer Bitcoin perpetual futures at the end of May, after which Kalshi expanded to other cryptocurrencies. Duffy argued that under the Dodd-Frank Act, perpetual futures should essentially be classified as swap products rather than standard futures. He also mentioned that CME holds exclusive licensing rights from the relevant benchmark providers, so such products, whether perpetual contracts or not, should go through CME.
