Nadella emphasized in court that Musk had never raised any objections to him regarding whether Microsoft's investment in OpenAI violated any specific terms or related commitments. In 2024, Musk filed a lawsuit against OpenAI, the company's CEO Sam Altman, and its president Greg Brockman, accusing them of abandoning the nonprofit commitments made during the startup phase and leveraging the nonprofit organization as a facade to shift toward commercial profit-making, thereby violating charitable trust responsibilities. Microsoft was also named as a defendant in the case. Musk alleged that Microsoft aided and abetted OpenAI in actions that allegedly violated the purpose of the charitable trust. Since 2019, Microsoft has been a major investor in OpenAI, and in 2023, Microsoft made a substantial $10 billion investment in OpenAI. Musk believes this $10 billion investment was a critical turning point that led him to conclude that OpenAI was straying from its nonprofit mission.
