ELON OFFERED $97.4 BILLION TO BUY OPENAI AND SAM ALTMAN SAID NO.
That decision is looking more complicated by the day.
Here is the full picture:
OpenAI just converted from a nonprofit to a for-profit company.
They are burning through cash at a rate that makes the $97.4 billion offer look different in hindsight.
The court case questioning whether that conversion violated the original founding mission is still live.
The 2017 founding documents said the nonprofit structure existed specifically to prevent decisions that benefit shareholders over humanity.
The 2025 structure has shareholders.
The gap between those two things is exactly what the lawsuit is about.
$97.4 billion would have ended the legal exposure, the cash burn questions, and the mission drift argument in one transaction.
The answer was no.
Now the courts get to decide what the founding documents actually mean.
History will have a very clear opinion about which decision was correct.
