Elon's lawsuit against Sam Altman/OpenAI officially begins in Oakland Federal Court!
At present, the Northern District Court of California is conducting jury selection, and the hearing is expected to begin tomorrow (Tuesday). The civil jury trial is expected to last for 2 to 4 weeks, with Judge Yvonne Gonzalez Rogers making the final decision.
The origin of the lawsuit is as follows:
one ️⃣ In 2015, Elon co founded OpenAI with Sam Altman and others, initially positioned as a non-profit organization with a mission to "safely and openly develop artificial general intelligence (AGI) for the benefit of all humanity. This company should not have pursued profits or been controlled by a closed enterprise. Elon was the largest early donor, donating approximately $38-44 million (about 60% of early seed funding) and providing computing resources and recruiting talent.
two ️⃣ In 2018, Elon left the board of directors due to objections to the company's direction and Microsoft's increasing influence.
three ️⃣ Afterwards, OpenAI received billions of dollars in investment from Microsoft and reorganized into a structure with a "profit department" (gradually moving from a "profit cap" to full commercialization), moving towards closed source code. After ChatGPT became popular, the company's valuation skyrocketed to approximately $852 billion, and it has recently completed a restructuring - the for-profit entity remains accountable to non-profit foundations.
Elon accuses Altman, Brockman, and OpenAI of violating the charitable trust and agreement established at the time of their founding, turning the company into a 'wealth machine' that prioritizes internal personnel and profits over its original mission. This is a deceptive behavior.
This lawsuit was first filed in November 2024, later withdrawn, and re filed in early 2026. Last Friday (April 24th), Elon voluntarily dropped the "fraud" charges, focusing the case on "mission violation" and "unjust enrichment".
Elon hopes to retrieve from Sam and OpenAI, including:
• Huge compensation: The amount is over 100 billion US dollars (reported to be about 134 billion US dollars), all donated to non-profit/charitable sectors, and Elon himself does not take any money.
Possible dissolution or restructuring of the company to restore its original non-profit mission.
Leadership turnover (such as removing Altman and Brockman from key positions).
OpenAI countered by stating that Elon actually knew and supported commercialization back then, and even considered merging with Tesla or taking control of the company himself. This lawsuit is fundamentally a "sabotage operation" launched by Elon's xAI for competition, driven by jealousy towards OpenAI's success.
This trial is crucial for the entire AI world.
Elon has always warned that profit oriented, closed source AGI is very dangerous. This is his last chance to enforce the original mission of "benefiting humanity" after he personally founded it and left in 2018.
If Elon wins, OpenAI's valuation, upcoming IPO, partnership with Microsoft, and market dominance will all suffer a heavy blow, and it will also force the world's leading AI laboratory to change its business model, affecting the entire AI race and future regulations.
Sam Altman is simply not trustworthy to control the future of AGI, and this trial proves why Elon fought against him in the first place.
This is the person who was fired by his own board of directors in 2023 on the grounds of "not being honest enough", and later crawled back to turn his non-profit promise of "open to all humanity" into a Microsoft funded, closed source, and multi billion dollar profit-making machine.
Elon was the one who initially provided the money and vision to make AI safe and beneficial for everyone, rather than becoming an internal club for billionaires.
If Altman could rewrite the rules afterwards, it would be like telling the world that 'mission oriented technology is just a marketing slogan'.
Elon is not doing it for self-esteem or competition, he really wants to hold on to the last line of defense before AGI, which exceeds human profits, becomes unstoppable.
This is a very personal battle for someone who truly wants to understand the universe rather than just making money.
Humanity needs Elon to win.
