Previously, at the end of last month, a judge in a federal court in San Francisco issued a preliminary injunction in a related case, prohibiting the Trump administration from enforcing a ban on the use of Anthropic's Claude AI model. In its ruling, the appeals court stated: 'We believe the balance of equities in this case favors the government.' 'On one hand, the risk of economic loss to a private company is relatively minor; on the other hand, during periods of military conflict, judicial oversight is necessary regarding how and through whom the Department of War acquires critical AI technology. Therefore, we deny Anthropic's motion for a stay of execution pending substantive review of the case.' (CNBC)
