[Crypto Lawyer: Drift Incident May Constitute 'Civil Negligence']
According to a report by Jinse Finance on April 6, lawyer Ariel Givner stated that if the Drift team had followed standard operational security procedures, the hacking attack on the Solana-based decentralized finance (DeFi) platform Drift Protocol could have been avoided, and the incident may constitute 'civil negligence.'
'In layman's terms, civil negligence means they failed to fulfill the basic duty of protecting the funds under their management,' Givner said in response to the post-incident analysis report provided by the Drift team and their handling of Wednesday's $280 million vulnerability incident.
The Drift team failed to follow 'basic' security procedures, including storing signing keys in an independent, 'physically isolated' system that is never used for development work, as well as conducting due diligence on blockchain developers met through industry conferences.
