Brazil passes new law: Confiscation of encrypted assets will be used for public safety expenditures, increasing efforts to combat crime Odaily Planet Daily News: Brazilian President Lula has signed Law 15358, which specifies that encrypted assets seized during law enforcement will be included in the public safety funding system for expenses such as police equipment, intelligence operations, and personnel training. This law allows for temporary use of relevant encrypted assets with the approval of the court until the final conviction. The new regulations significantly expand the jurisdiction of judicial authorities, allowing them to freeze, block, or confiscate encrypted assets during the investigation phase, including restricting access to exchange accounts, digital wallets, and related platforms. Once convicted, the individuals involved will be permanently deprived of their eligibility to use the formal financial system and encryption system. In addition, the law will include the use of encrypted communication tools or privacy technologies to conceal criminal behavior as an aggravating circumstance, and promote cross-border asset recovery and intelligence sharing, while establishing a national level database that integrates the financial structure of criminal organizations. Analysis suggests that this measure marks Brazil's shift from potential reserve tools to law enforcement resources for encrypted assets, strengthening the crackdown on organized crime such as PCC and Comando Vermelho, while promoting the upgrading of the judicial system's regulatory and disposal capabilities for digital assets.
