Creating a US nexus by advertising to American’s means an illegal offshore entity becomes exposed to CFTC regulations. Polymarket has done this from the beginning. But the CFTC fails to hold them to US laws because Trump gutted the enforcement division. The problem isn’t “prediction markets” it’s the same Trump corruption that has always existed allowing illegal actions when it suits him. While failing to comply with US laws on markets about war, the CFTC is actively letting Polymarket pursue a US licensed division. Which you’re not supposed to be allowed to do, if you have a non-compliant division with a US nexus. If you want to clean up that industry, you don’t need new laws.
