The plaintiffs stated that this death exclusion policy was not included in the summary of rules provided to users, nor was it publicly disclosed in a way that would allow an 'ordinary rational consumer' to notice the policy and its implications. The lawsuit document states: 'The defendants themselves later admitted that the previous disclosure contained grammatical ambiguities.' After the death of former Iranian Supreme Leader Khamenei was confirmed, Kalshi announced that the trading positions in this market were invalid, meaning the market was not determined to have a 'Yes' outcome. Kalshi co-founder Tarek Mansour stated: 'We do not launch markets directly tied to death. For markets where potential outcomes may involve death, we design rules to prevent anyone from profiting from death.'
