[U.S. SEC Submits Regulatory Guidance Document to OIRA, Clarifying How Federal Securities Laws Apply to Specific Crypto Assets and Related Transactions]
According to a report by Golden Finance and disclosed by crypto journalist Eleanor Terrett, today, the U.S. Securities and Exchange Commission (SEC) submitted a regulatory guidance document to the Office of Information and Regulatory Affairs (OIRA), clarifying how federal securities laws apply to specific crypto assets and related transactions.
Although the guidance document itself does not change the law, the fact that it is issued by the Commission rather than regular staff indicates that the SEC believes this guidance has significant market impact. Notably, this guidance is independent of the SEC's currently unresolved proposal for crypto asset issuance rules.
Once the guidance passes OIRA's interagency review, the three commissioners of the SEC will vote on it.
An SEC spokesperson stated: 'As Chairman Atkins has mentioned, the Commission will review interpretive guidance surrounding the classification of crypto asset tokens — aligned with market structure legislation — to ensure investors and innovators have a clear understanding of their regulatory obligations.'
