If the @MassAGO wants a fight on her hands - she’s got one. Let me be CLEAR: Yesterday, I, along with a taxpayer coalition filed suit regarding the audit. Today, @massauditor also filed suit. I believe @DianaDiZoglio to be on the right side. Simply put, Andrea Campbell has failed to act in the public’s interest. The taxpayer lawsuit I’m leading is VERY DIFFERENT than the Auditor’s. The AG will argue the law mandates the AG as the sole lawyer for state officers. The AG asserted that @DianaDiZoglio has no authority to sue. In short, Andrea Campbell can move to dismiss the Auditor’s case as unauthorized litigation. Based on her comments, it appears that’s the way the AG is headed. 🤬 The AG however cannot do the same regarding the taxpayer lawsuit I filed. The AG claims the Auditor has no authority to sue. She cannot claim the same regarding the taxpayer lawsuit. We have a STATUTORY RIGHT under G.L. c. 29, § 63 to stop the Legislature from using our own money to hire high-priced lawyers to block a law 72% of us voted for. The Auditor’s suit will be classified by the AG - and the Legislature - as a fight over power between two coequal branches of government. They will argue Separation of Powers under the Constitution as a defense. Our taxpayer suit isn’t a fight over power - it’s a fight over the checkbook. In sum, even if the court decides the Auditor can't sue without the AG’s permission - the court can still find in favor of taxpayers and the lawsuit moves forward. #mapoli #DoTheAudit(John E Deaton)
