His claim that FTX "wasn't bankrupt" doesn't matter. He illegally used peoples deposit assets, which he did not have title to, for investments and to buy himself lavish goods. If you steal $5 and buy a pizza, then claiming "I can pay you back $5 of pizza" does NOT mean you didn't steal.
