I honestly don’t know if @EdMarkey is intentionally gaslighting people or if genuinely does not understand qualified immunity. First, the word itself should provide some insight. It’s called qualified immunity, Ed - not absolute immunity. Second, qualified immunity only applies to civil lawsuits against officers in their individual capacities. Third, qualified immunity has zero impact on whether a District Attorney or DOJ can charge an officer with a crime (e.g., manslaughter or murder). Fourth, families can still sue law enforcement officers for civil rights violations, including wrongful death cases. Often times, in wrongful shooting cases, the case proceeds to trial. In sum, qualified immunity is not a get out of jail free card, nor does it block all lawsuits. Instead, it is a legal doctrine that protects government officials from civil liability UNLESS their conduct violates clearly established statutory or constitutional rights.(John E Deaton)
