[Russian Constitutional Court Rules Crypto Assets Protected by Property Rights, USDT Lending Case Becomes Key Precedent]
According to a report by Jinse Finance, the Russian Constitutional Court has issued a ruling on a 2023 USDT lending dispute, clarifying that crypto assets should be protected under property rights law and determining that there is no legal basis to deny property rights to crypto asset holders. The ruling stated that lower courts acted improperly by refusing judicial relief on the grounds that 'stablecoins are not covered under current digital financial asset legislation.' Additionally, the failure to report crypto assets to tax authorities does not constitute a reason to deny property rights protection, as the reporting obligation applies only to miners. Legal experts believe this ruling establishes an important precedent for civil and criminal cases involving digital assets and urges legislative bodies to expedite the clarification of the legal status of crypto assets.
