**[Musk Files $134 Billion "Unjust Enrichment" Claim Against OpenAI and Microsoft]**
BlockBeats News, January 18: According to US News, a federal judge in California has rejected OpenAI and Microsoft's request to dismiss Musk's lawsuit. The case against OpenAI will proceed to a jury trial in April. Recently, Musk's team officially filed a $134 billion "unjust enrichment" claim, estimating OpenAI's unjust enrichment to be between $65.5 billion and $109.4 billion, and Microsoft's unjust enrichment to be between $13.3 billion and $25.1 billion, with the total range approximately between $79 billion and $134 billion. Musk's legal team has hired financial economist C. Paul Wazzan as an expert witness, who ultimately calculated this staggering figure.
In 2015, Musk co-founded OpenAI and provided approximately $38 million in seed funding, accounting for 60% of the early seed round financing at the time. He also claims to have contributed his personal reputation, key connections, and experience in scaling enterprises, stating, "Without Musk, there would be no OpenAI." Currently, OpenAI has transitioned into a for-profit entity with an estimated valuation of $500 billion, and Musk believes he is entitled to a proportional "unjust enrichment" compensation.
Musk has long accused OpenAI of deviating from its original mission of being a nonprofit organization dedicated to benefiting humanity, instead forming a deep partnership with Microsoft and becoming a for-profit company controlled by Microsoft.
