TO: The political experts and pundits claiming I shouldn’t be so vocal about a bankruptcy case while running for U.S. Senate. Before deciding to run for office, I offered my pro bono legal services to thousands of ordinary people who invested in private equity on the @linqtoinc platform. On the Linqto Platform, approximately 13K investors invested over $400M dollars - now worth over $1B dollars. Of the 13K investors, over 11K of them are XRP holders. Prior to representing people in the Linqto case, I served as amicus counsel in the @SECGov 🆚 @Ripple case and 75K XRP Holders joined me in fighting against the SEC’s gross overreach. The federal judge, who happens to be a lifetime democrat, appointed by @BarackObama, cited my brief and the thousands of XRP Holder Affidavits that I submitted in the case when she ruled XRP itself is NOT a security. I did that 3 year legal work pro bono, spending my own money to fund it. When Linqto filed for bankruptcy many of those same XRP Holders who had invested on the platform looked to me for help and guidance. Over 4K of them signed up for me to represent their interests in Court because they trust me. Many of them, have their life savings or a significant percentage of their life savings on the platform. I’ve read hundreds of emails of stories that would touch your heart. A seventy-five year old widower who invested everything she has ($400,000) on the platform is just one example. Before deciding to run for U.S. Senate, I agreed to represent their interests, keep them updated and guide them through a very stressful process. Just because I decided to run for U.S. Senate, doesn’t mean I should not follow through and be a man of my word. If I did walk away now, what kind of public servant would I be? Maybe it’s time we start electing people who are willing to put people first. As the federal bankruptcy judge stated on the record: customers of Linqto were defrauded. In fraud cases that have led to bankruptcy, oftentimes, customers lose everything or only receive a fraction of what they are owed. In this Linqto case, it appears customers should receive 95% of what they are entitled to (including the upside in shares). If approved, this would prove to be the best bankruptcy result in a fraud case in modern history. Period. If that happens, I don’t deserve the credit but I’m proud of playing a small part of it. Maybe some folks in the media or political world think it serves as a distraction for me but I plan to bring the same level of integrity, attitude and work ethic that I’ve maintained representing and protecting innocent investors to representing my country and the MA citizens and taxpayers I’m asking to vote for me.
