According to a report by Crypto In America, as cited by Jinse Finance, Canary Capital's XRP spot ETF could become the next cryptocurrency fund to land on Wall Street. This follows the company's submission of a revised S-1 filing last Friday. The document was quietly amended on October 24, removing the "delayed amendment" that granted the U.S. Securities and Exchange Commission (SEC) the authority to determine the effective registration date, thereby clearing the way for a potential listing on November 13, provided Nasdaq approves the critical Form 8-A required for the listing.
This move follows the legal mechanism used by Bitwise and Canary earlier this week when launching Solana, Hedera, and Litecoin ETFs, leveraging the 20-day statutory waiting period stipulated under Section 8(a) of the Securities Act of 1933. This provision states that unless the SEC declares an earlier effective date, the registration statement will automatically take effect 20 days after submission. SEC Chairman Paul Atkins has expressed support for this approach and praised MapLight for utilizing the automatic effectiveness method during a government shutdown to achieve a listing.
Fidelity, VanEck, and Canary all updated their Solana ETF registration information this week, removing the delayed effectiveness amendment and planning to launch their products after receiving exchange approval in mid-November. If Canary's XRP ETF is issued on November 13, it will give the company a competitive edge over other issuers who have filed applications for XRP ETFs, including Bitwise, Franklin Templeton, 21Shares, and Grayscale, none of whom have updated their application documents yet.
