[Nike and StockX End Trademark Dispute Over NFTs and Counterfeit Sneakers]
According to Decrypt, Nike Inc. and Detroit-based online trading platform StockX reached a settlement last Friday in federal court in New York, resolving a three-year lawsuit over issues related to sneaker NFTs and trademark misuse. Previously, a judge had ruled that the resale platform was selling counterfeit sneakers, a decision made more than six months ago. The settlement immediately canceled the jury trial originally scheduled for October and dismissed all claims with prejudice. This move spares StockX from the risk of an unfavorable ruling while also allowing Nike to avoid the uncertainty of presenting its brand protection strategy before a jury. The case was filed in February 2022 in the Southern District of New York, when Nike accused StockX of trademark infringement and dilution, alleging that its "Vault" NFTs used unauthorized images of Nike sneakers to sell tokens tied to physical shoes.
