After a hearing on May 30th, US federal judge Katherine Polk Failed refused to request the Department of Justice (DOJ) to re-examine its records in order to find materials that may be favorable to Tornado Cash developer Roman Storm. Judge Failed stated that she believes the Department of Justice did not violate the "Brady Rule" (which states that the prosecution has an obligation to disclose evidence to the defense that may reduce the defendant's guilt), and pointed out that the communication between the DOJ and the Financial Crimes Enforcement Network (FinCEN) regarding whether the mixer needs to be registered as a money service business does not apply to this case.
