**[Kalshi Requests En Banc Review by Sixth Circuit Court Regarding Ohio and Tennessee Rulings]**
According to a report by DeFi Rate on October 14, prediction market platform Kalshi submitted an en banc review application to the U.S. Sixth Circuit Court of Appeals on October 13, requesting a reconsideration of the court's rulings in the cases "Kalshi v. Ohio Schuler" and "Kalshi v. Tennessee Orgel."
In late September, the three-judge panel upheld the decision not to issue a preliminary injunction against Ohio's gambling regulatory and enforcement agencies while overturning the previous preliminary injunction against Tennessee's related agencies.
In its application, Kalshi argued that the panel misinterpreted the Commodity Exchange Act (CEA) in two key areas: first, whether federal securities laws take precedence over state gambling laws, and second, whether sports event contracts constitute "swaps."
The likelihood of an en banc review being granted is typically low, but Kalshi stated it is still waiting for the right opportunity to submit its case to the Supreme Court.
