Rochon of the Southern District of New York has dismissed a class action lawsuit related to the issuance of LIBRA and M3M3 tokens against Hayden Davis, Kelsier Ventures, former Meteora CEO Ben Chow, and others, and denied the plaintiffs' request to amend the complaint again. The court found that the plaintiffs failed to sufficiently demonstrate that Meteora constituted a suable illegal entity and that the RICO (Racketeer Influenced and Corrupt Organizations Act) allegations against the defendants did not meet the legal requirements for demonstrating a pattern of criminal activity. Additionally, the fraud allegations against Ben Chow did not meet the required evidentiary standards. The court emphasized that this ruling is solely based on whether the plaintiffs' claims and legal requirements were established and does not make any factual determination regarding whether market manipulation, fraud, or other misconduct occurred during the issuance of LIBRA or M3M3.
