[CFTC Submits Two Rules to the White House Defining Event Contract Swap Attributes]
According to The Block, the U.S. Commodity Futures Trading Commission (CFTC) has submitted two regulatory proposals to the White House Office of Information and Regulatory Affairs (OIRA):
1. A proposed rule to explicitly include 'event contracts' within the definition of 'swap,' which will subsequently enter a public comment period.
2. An interim final rule to exclude 'casino-style gambling products' from the definition of 'swap,' which will take effect upon administrative approval.
This move is seen as a response to rulings by the Sixth and Ninth Circuit Courts of Appeals, with the Supreme Court having accepted three appeals related to the definition of swaps.
