Frankfurt Regional Court ruled Meta liable for fake investment scam ads. The court didn't rule against Meta simply because fraudulent ads existed on its platform and got reported that alone usually isn't enough to defeat passive host protections designed to shield platforms from liability for third party content. Court ruled against Meta specifically because of the mechanism by which those ads reached people: an algorithm that actively selects and an auction system that actively prices and places them. That's a narrower and more consequential distinction than it first appears, because algorithmic targeting and automated ad auctions aren't an edge case of Meta's business they're the entire business.
