Judge postpones hearing on Aave's application to unfreeze $71 million stolen ETH Odaily Planet Daily News: New York judge Margaret M. Garnett postponed a ruling on Aave's emergency application on Wednesday, which aims to unfreeze $71 million in ETH related to the Kelp DAO hacking incident, and requested both parties to submit supplementary opinions before the June 5th hearing. Aave attempted to retrieve $71 million in ETH frozen by Arbitrarum to assist in the asset recovery of the hacking incident. The Kelp DAO suffered a loss of $293 million in this hacking attack. American law firm Gerstein Harrow LLP filed a restraining order with the court in early May, claiming that its clients have rights to the aforementioned funds. Aave subsequently proposed an emergency motion to lift the freeze and stated that if the funds cannot be released in a timely manner, it will trigger user liquidation and may affect the DeFi market. Judge Garnett pointed out in the ruling that Aave failed to fully explain how user funds would incur "compound interest losses" if the restraining order was upheld. She also acknowledged the complexity of the case and the risks faced by the victims, and requested both parties to provide additional statements on six key issues. Both parties must submit supplementary opinions before May 22nd. At the same time, the overall compensation work of Kelp DAO is progressing. Kelp and Aave announced on Tuesday that the rsETH held by hackers has been destroyed on Arbitrum, and approximately $278 million in lost tokens will be recovered through the Aave Recovery Guardian multi signature wallet in the next two weeks. After the relevant smart contracts are reactivated, all functions of rsETH will be restored to normal.
