According to materials forwarded by Eleanor Terrett, the judge's view is that holding software developers responsible for the misuse of neutral infrastructure by strangers would be illogical, as Uniswap is considered a "neutral infrastructure," while Tornado Cash is considered to have "participated in illegal financial activities" (knowingly continuing to operate even after being used for money laundering). This statement suggests that US courts may consider whether developers only provide neutral tools rather than participate in illegal activities when determining liability for decentralized finance (DeFi) infrastructure in the future.
