Anton and James Peraire-Bueno, two brothers, have been charged with money laundering and fraud—related to a $25 million attack on the Ethereum blockchain—and they may face a second trial as early as February.
On Monday (May 12), documents submitted to the U.S. District Court for the Southern District of New York revealed that lawyers representing the U.S. government requested that a federal judge schedule a retrial for the Peraire-Bueno brothers "as soon as possible in late February or early March 2026."
This request was made about three days after the judge declared the trial a mistrial, following the jury's inability to reach a verdict.
The brothers are accused of conspiring to commit wire fraud, money laundering, and conspiring to receive stolen property, charges related to their use of a maximum extractable value (MEV) bot to attack $25 million in digital assets in 2023.
The case has garnered significant attention within the crypto industry, as a guilty verdict could impact Ethereum transactions. If found guilty in the retrial, the brothers could still face decades in prison.
The jury deliberated for over three days before reporting to the judge that they could not reach a verdict. During this time, the jury raised several questions seeking clarification on testimony provided during the trial, as well as the definition of "good faith."
According to a letter submitted in the publicly available records on Monday, "Yesterday, half of the jurors spontaneously broke down emotionally, and several jurors reported multiple nights of insomnia. While this is a minor issue, we have all endured economic and psychological hardships from being isolated from work and family for nearly a month."
As of Wednesday (May 14), the judge had not announced a possible date for the retrial.
