[Hong Kong SFC Proposes Restricting Unauthorized Use of Terms Like "Cryptocurrency Exchange" That Could Mislead Regulatory Identity] According to Foresight News, the Hong Kong Securities and Futures Commission (SFC) has released a consultation summary proposing amendments to the Securities and Futures Ordinance and the Anti-Money Laundering and Counter-Terrorist Financing Ordinance. These amendments would restrict unauthorized entities from using specific terms that could mislead the public into believing their business is regulated by the SFC or that they are associated with exchanges, clearinghouses, and virtual asset trading platforms.
The proposed restricted terms include "crypto", "cryptocurrency", "crypto coin", "digital asset", "digital coin", "token", "tokenised assets", "virtual asset", "virtual coin", as well as "exchange", "market", and "trading platform". The Hong Kong Securities and Futures Commission stated that the restrictions target combinations of the above terms and similar terms, and that the use of a single term alone will not necessarily result in restrictions. It is expected that the relevant legislative amendment draft will be submitted to the Legislative Council for deliberation after it is finalized. If the amendment is passed, the relevant provisions will take effect six months after they are enacted.
