The U.S. Commodity Futures Trading Commission (CFTC) has issued a new legal interpretation requiring designated contract markets (DCMs), including Kalshi and Polymarket, to refrain from restricting user access by state. Platforms that have already implemented territorial restrictions must restore service within 30 days or explain to regulators why they cannot restore it. This requirement conflicts with some court rulings restricting prediction market platforms. Currently, Kalshi has restricted user trading in Nevada, Washington, and Michigan, and a California federal court has also prohibited it from offering sports event contracts on Native American land in question. CFTC Chairman Michael Selig stated that territorial access restrictions do not meet the fair access requirements of the Commodity Exchange Act and could weaken market liquidity. Meanwhile, several states still argue that prediction market sports contracts fall under the jurisdiction of state gambling laws, continuing the dispute between federal and state regulatory authority.
