🐋 WHALE WATCH : The SEC added three new answers on what makes a crypto network decentralized without waiting for Congress.
The guidance covers three points. Token holders voting on a network dont count as a central party unless theyre affiliated or coordinating together. A central party oversees participation if it controls access at the protocol validator or user level. A network being functional the token works on it is distinct from being decentralized nobody controls it.
The timing matters. The CLARITY Act failed a Senate vote 49 50 on September 15. The SEC moved four times in the two weeks after a tokenized US stocks trading exemption on September 17 a crypto FAQ on securities law on September 25 an investment adviser and fund crypto custody proposal on October 1 and now this.
Congress stalled. The SEC kept writing rules.
